Lloyd#13: Since Muhammad married Aisha, so can others!

Lloyd begins this video with reminding us that everything we hear about in Shariah law is from the rulings of the Mujtahids, which are considered absolute for all times, and for all places, and for all peoples, and cannot be annulled (see "Reliance of the Traveler', book 7.3, pg. 24, or pg. 42 in the PDF). So, what about Muhammad marrying his favourite wife Aisha when she was only 6 years old? This question was asked on the popular Islamic website, 'Islam Q&Q' where they answered that it was perfectly permissible to marry a girl below the age of 10 years without their permission, due to the consensus of the Mujtahid on this point, and support from the Qur'an - Surah 65:4, which says "For those who have no course (i.e. no period, thus prepubescent), the iddah (waiting period before when first married) is 3 months". So, it gives permission to marry girls who are prepubescent. The reason for this is the example of Muhammad himself and Aisha (according to Al Bukhari 4840 and Sahih Muslim 1422), where he consummated the marriage when she was only 9 years old, and without her consent (something we in the West would call Marital rape). A modern day example would be the 2nd largest Muslim country, Pakistan, where the Muslims there, in order to understand the application of Surah 65:4, follow 3 manuals of authority, 1) The Hedaya Manual, 2) The Digest of Muhammadan Law, and 3) The Muhammadan Law by Syed Ameer Ali. In the latter, on page 26 it states that if the girl is under 9 and her vagina is ruptured, or torn, the husband must stop, but if not then he can carry on, as her body can take it. It goes on to say that if his penis is too large and he ruptures the wall between the vagina and the anal canal (known as 'Fistula') he should desist, though nothing will happen to him. But the damage has already been done, and this would continue for the duration of the girls life. In India (the 3rd largest Muslim country today), they use the "Jewels of Paradise" as their manual on Islamic principles and morality. In Chapter 11.2 it says that a young female baby cannot decide right from wrong, so cannot be held accountable if a man has sex with her, permitting other men to do so, while the husband cannot say anything because the girl is too young to know better. What's more, it goes on to say in Chapter 12.2 that if the man was caught having sex with a prepubescent girl, nothing can happen to her as she is too young to know better, but if she was older than both of them should be stoned. These is a difficult subject to talk about and try to understand, yet Muslims are going to have to decide whether these rulings are relevant for today, or any day, or anywhere or for any one.
